๐จ Reporting Abuse
InterServer follows generally accepted abuse practices. In most cases, we will forward a complaint downstream to the IP owner.
Exceptions are made for extremely clear, verifiable, and obvious abuse that constitutes an immediate violation of our Terms of Service (https://www.interserver.net/terms-of-service.html).
In many cases, InterServer does not directly manage or control the end-user instance but may be able to take action, such as blocking an IP address.
SPAM, Scanning and general abuse can be sent to abuse @ interserver.net following accepted industry standards for abuse reporting.
What to Include in Your Abuse Report
All abuse complaints must be backed up with documentation. Please include:
- Type of abuse (e.g., Spam, Phishing, Malware)
- Date and time (including timezone) of the incident
- Source IP address
- Targeted IP address
- Relevant logs (such as ports and protocols)
- For content violations (e.g., phishing), provide the specific URLs where the content is located.
- For audio or video files, provide a timestamp of the reported violation.
Protections Against Fraudulent Takedown Notices
InterServer is here to protect our clients from unwarranted, fake takedown notices and to ensure the continued protection of speech.
Bad-faith legal notices used to disrupt service are recognized as administrative abuse. Under federal law, 17 U.S.C. ยง 512(f), any person who knowingly and materially misrepresents that material is infringing is liable for damages and attorneyโs fees. Furthermore, the 9th Circuit ruling in Lenz v. Universal Music Corp. (2015) requires copyright holders to consider โfair useโ before issuing a notice. In New Jersey, the intentional submission of false claims to disrupt a business relationship is actionable as Tortious Interference with Contractual Relations (Printing Mart-Morristown v. Sharp Electronics Corp., 116 N.J. 739).
Harassment of Staff and Legal Correspondence
InterServer maintains a zero-tolerance policy regarding the harassment of our support and technical staff. If you have been directed to communicate with our Legal Department or Abuse Department, all further inquiries must be handled exclusively through that channel.
Continued unsolicited contact, threats, or the use of coarse language toward non-legal staff after a referral may constitute harassment under N.J.S.A. 2C:33-4. InterServer reserves the right to terminate communication, restrict account access, or pursue criminal and civil remedies against individuals who engage in such behavior.
๐ฎ Law Enforcement & Legal Orders
If you are aware of criminal activity, your first step should always be to contact the appropriate law enforcement agency. They can then contact us, if appropriate.
- Jurisdiction: InterServer services are located within the United States. We adhere to local Federal and State laws. A takedown notice that is not specific to US law must come from an appropriate agency in that jurisdiction to request a takedown.
- Customer Information: InterServer does not disclose customer information without a valid, recognized legal subpoena or court order. For more information, see our Privacy Notice (https://www.interserver.net/privacy-policy.html). Unless legally prohibited, InterServer will provide customers with reasonable notice of any demand for their data, allowing them the opportunity to seek a protective order or other legal remedy.
๐ DMCA (Digital Millennium Copyright Act) Complaints
If your specific copyrighted content is being infringed upon, you may submit a DMCA takedown notice. Specifications for the DMCA can be found at: http://www.copyright.gov/legislation/dmca.pdf
Filing a Complaint:
- You must specify exactly which material is being infringed (e.g., complete file names, full URLs).
- You must swear under penalty of perjury that you are the copyright holder or an authorized agent representing the holder.
- Complaints from individuals who are not the copyright owner may not be acted upon, except in cases of clear and obvious impersonation of a well-known global brand.
Designated Agent:
All DMCA complaints must be sent to InterServerโs designated agent registered with the US Copyright Office (https://dmca.copyright.gov/osp/).
- Email: dmca AT interserver.net
- Mail: InterServer Inc, PO BOX 1707, Englewood Cliffs, NJ 07632
- Fax: 201-526-6605 (must include a physical signature)
โ๏ธ Other Legal Matters
Domain Name Disputes
If your claim is against a domain name (e.g., a name similar to yours or a copyrighted name), please contact the domainโs registrar or ICANN: https://www.icann.org/resources/pages/help/dndr/udrp-en
Business Disputes
InterServer does not get involved in private business disputes or payment issues. Please contact your local attorney general in these cases.
Libel and Defamation
Please be aware that the burden of proof in libel cases is high; the plaintiff must prove that the statements were false, defamatory, and caused harm. A simple statement in an abuse complaint generally does not meet this threshold, and we advise you to seek legal counsel.
Additionally, InterServer is located in New Jersey. On September 7, 2023, New Jersey enacted the โUniform Public Expression Protection Actโ (anti-SLAPP legislation). This legislation is designed to protect people from meritless lawsuits intended to silence public criticism and the exercise of First Amendment rights.
Reporting CSAM
If you are reporting CSAM content, please begin the report at the NCMEC CyberTipline: https://report.cybertip.org.
NCMEC will:
- Evaluate alleged CSAM and Coordinate with law enforcement and providers
Is the site at Cloudflare? Please also submit a report at https://abuse.cloudflare.com/csam.
Reporting Revenge Porn
If you are reporting your own content or revenge porn, please indicate the URLs of the images to be taken offline. A takedown notice stating that the images are yours and are to be taken offline is sufficient.
Need assistance? Please review: https://stopncii.org/
Please do not attach your ID in a takedown notice; this is not a necessary step.
Sites Behind Cloudflare
If a site is behind Cloudflare, please include your Cloudflare ticket number that is under 7 days old. For reports over 7 days old, please resubmit to Cloudflare.
Because Cloudflare masks sites and sites can easily move, many follow-up reports are no longer hosted at the same IP and require a new report.
